I'm still iffy on how patent protection works. I think it's different than copyrights where you must go after everybody or else you lose the rights. Like Intel Inside logo, they went after AGD for a stupid sticker that said "LVL10 Inside." They legally had to do that despite it not honestly ever affecting their business.
But patents, I think (not 100% positive somebody who knows more please comment), can be selectively enforced. Such as if you have company A with a patent. And Companies B, C, and D all have similar designs. A can legally fight C only and B/D can be left alone. Or if you want a paintball example. Smart Parts, they went after AKA, after ICD, they go after them for their own personal reasons. Yet Kingman, Tippmann, blah blah have not gone to court on this.
